Terms of Service

These Terms of Service ("Terms") govern your use of the website and services provided by Luminary Booth Co ("we," "us," or "our"), a photo booth and event entertainment rental company operating in Maryland, Washington D.C., and Virginia. By submitting a booking inquiry, signing a service agreement, or using our website, you agree to be bound by these Terms.
Acceptance of Terms
By accessing our website or engaging our services, you confirm that you are at least 18 years of age and have the legal authority to enter into a binding agreement. If you are booking on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.
We reserve the right to update these Terms at any time. Continued use of our website or services after changes are posted constitutes acceptance of the revised Terms. The "Last Updated" date at the top of this page reflects the most recent revision.
Services & Booking
Luminary Booth Co provides mirror photo booth rentals — including studio-grade LED lighting, premium props, and in-app custom templates — along with optional add-ons such as extra hours, custom backdrops, stanchions with velvet rope, and runway carpet, for private and corporate events. The base rental starts at $350 for three (3) hours. All services are subject to availability and a signed service agreement.
- A booking is not confirmed until a signed service agreement and non-refundable deposit have been received.
- You are responsible for ensuring the venue has adequate space (minimum 10′ × 10′ footprint, 8′ ceiling clearance) and access to power (standard 120V outlet within 25 feet of the setup area).
- You must notify us of any venue restrictions, load-in limitations, or scheduling constraints at least 14 days before your event.
- Add-ons selected after the service agreement is signed are subject to availability and may be added to the final invoice at the published rate.
- We reserve the right to decline or cancel a booking if venue conditions are deemed unsafe or unsuitable for our equipment.
Payment & Cancellation
Deposit: A non-refundable deposit (typically 30–50% of the total booking) is required to secure your event date. The remaining balance is due no later than 7 days before your event.
Add-Ons: Add-on charges (extra hour, backdrop, stanchions, runway carpet) are billed at the published rate and may be confirmed up to 7 days before your event, subject to availability. Add-ons confirmed on event day are billed with the final invoice.
Cancellation by Client:
- Cancellations made 60 or more days before the event: deposit is forfeited; no further charges apply.
- Cancellations made 30–59 days before the event: 50% of the total booking is due.
- Cancellations made fewer than 30 days before the event: 100% of the total booking is due.
Rescheduling: One complimentary date transfer is available with at least 60 days' notice, subject to availability. Additional transfers may incur a rescheduling fee.
Cancellation by Luminary Booth Co: In the unlikely event we must cancel due to equipment failure, emergency, or force majeure, we will provide a full refund of all amounts paid or make reasonable efforts to arrange a comparable substitute. Our liability is limited to the amounts paid by the client.
Photo Rights & Usage
All photos and video clips captured using our equipment remain the intellectual property of Luminary Booth Co until a fully executed service agreement grants usage rights to the client. The following terms apply:
- Client license: Upon full payment, the client receives a non-exclusive, non-transferable license to use event captures for personal, non-commercial purposes.
- Portfolio use: We reserve the right to use event photos for our portfolio and marketing materials unless the client submits a written opt-out request prior to the event date.
- Guest consent: By hosting an event at which our services are used, you agree to inform guests that photo and video capture will occur and that participation is voluntary.
- Minors: You are responsible for obtaining parental or guardian consent before allowing minors to use our services or appear in captures intended for publication.
Liability & Indemnification
Limitation of Liability: To the fullest extent permitted by law, Luminary Booth Co's total liability for any claim arising from or related to our services shall not exceed the amount paid by you for the specific service giving rise to the claim. We are not liable for indirect, incidental, special, or consequential damages, including lost profits or data loss.
Equipment & Property: You agree to ensure that guests and venue staff do not tamper with, damage, or misuse our equipment. You are responsible for costs to repair or replace equipment damaged due to misuse, negligence, or malicious acts by you, your guests, or venue staff during your event.
Indemnification: You agree to indemnify, defend, and hold harmless Luminary Booth Co and its representatives from any claims, damages, or expenses (including reasonable attorney's fees) arising out of your breach of these Terms, your event, or your guests' conduct.
Force Majeure: Neither party is liable for delays or failures caused by circumstances beyond reasonable control, including natural disasters, government orders, venue closures, or public health emergencies.
Governing Law
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-law provisions. Any disputes arising under or related to these Terms shall be resolved exclusively in the state or federal courts located in Maryland, and you consent to the personal jurisdiction of those courts.
If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
